What this service is
This is a free triage tool. It walks the classification tests in Regulation (EU) 2024/1689, as amended by the Digital Omnibus, in the order the regulation applies them, and tells you where your system appears to sit and which article that rests on. It is free to use, requires no account, and gives its determination on screen. You may optionally give an email address to receive a compiled report.
This is not legal advice
Nothing on this site is legal advice, and using it creates no lawyer-client relationship. The tool produces a structured first pass, not a legal opinion. Several of the tests it runs, the Article 6(3) derogation and role determination in particular, turn on facts about your product and your organisation that a questionnaire cannot see. A determination here is a starting point for a conversation with qualified counsel, not a substitute for one.
Do not rely on the output as your sole basis for a regulatory filing, a conformity assessment, a contractual representation, or a decision to place a system on the market.
Accuracy and currency
The content reflects the regulation as reviewed on 22 July 2026. At that date the Digital Omnibus had been adopted and signed but was awaiting publication in the Official Journal, so the consolidated text and the final regulation number were not yet authoritative. The law moves, guidance arrives, and pages here may lag it.
Where sources genuinely disagree, the site says so rather than picking one silently. Where the conservative reading and the permissive reading differ, it tells you which is which. That is the most we can offer, and it is not a warranty of correctness. Always check the text on EUR-Lex before acting.
Acceptable use
By using this site you agree not to:
- submit an email address that is not yours, or that you have no permission to use;
- attempt to circumvent the rate limit on the report endpoint, or use it to send unsolicited mail;
- scrape, mirror or bulk-download the content, or use automated means to interact with the tool beyond ordinary use;
- probe, disrupt or attempt to gain unauthorised access to the service or its infrastructure;
- present the output as a legal opinion, a certification, or the work of a regulator.
Report requests are limited per network address. Hitting that limit is not a fault and clears on its own.
Intellectual property
The text, structure, classification logic and design of this site belong to Particula Tech. The underlying legislation is a public document and nothing here claims rights over it. You may quote short passages with attribution and a link, and you may link freely to any page.
The report you generate is yours. Use it internally, attach it to your own documentation, and share it inside your organisation without asking us. Republishing the site content wholesale, or rebuilding the tool from it, is not permitted.
No warranty, and what we are liable for
The service is provided as is. We do not warrant that it will be uninterrupted, that the determination will be correct for your system, or that the content is complete or current at the moment you read it.
To the fullest extent permitted by law, we are not liable for any loss arising from reliance on the output, including regulatory penalties, missed deadlines, lost profits, or the cost of remediation. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are unaffected.
Changes, and the law that applies
We may change these terms. The last-updated date at the top of this page reflects the current version, and continuing to use the site after a change means accepting it. We may also change or withdraw the tool itself.
